Terms of Service

1. Eligibility

Fanager is rated 4+ and is available to users of all ages. If you are under the age of 13, you must have your parent or legal guardian's permission to use the App and create an account. By creating an account for a child under 13, the parent or guardian agrees to these Terms on the child's behalf and assumes responsibility for the child's use of the App.

2. Account Registration

To access certain features, you must create an account using Google Sign-In, Apple Sign-In, or email registration. You agree to:

• Provide accurate and complete information
• Keep your account credentials secure
• Notify us promptly of any unauthorized use of your account
• Accept responsibility for all activity that occurs under your account

You may only maintain one account per person. We reserve the right to suspend or terminate accounts that violate these Terms.

3. Description of Service

Fanager is a recreational sports league management application. The App allows users to:

• Create and manage leagues, teams, seasons, tournaments, and matches
• Record and view match scores and schedules
• Follow leagues and teams as a spectator
• Upload images including league logos, team logos, and banners
• Receive push notifications about followed leagues and teams

Some features may require a paid subscription or one-time purchase, which are processed through Stripe.

4. User-Generated Content

4.1 Your Content

You retain ownership of any content you submit to Fanager, including league names, team names, descriptions, images, and other materials ("User Content"). By submitting User Content, you grant Kimusoft a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your User Content solely for the purpose of operating and improving the App.

4.2 Content Standards

You agree not to submit User Content that:

• Is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Infringes on any patent, trademark, copyright, or other proprietary right of any party
• Contains personally identifiable information of another person without their consent
• Promotes illegal activities or violence
• Contains spam, advertising, or solicitation
• Impersonates any person or entity
• Contains viruses, malware, or other harmful code

4.3 Content Moderation

We employ automated systems including profanity filters and image moderation to review User Content. We also allow users to report content that may violate these Terms. We reserve the right, but are not obligated, to:

• Review, modify, or remove any User Content at our sole discretion
• Suspend or terminate accounts that repeatedly violate content standards
• Take any action we deem necessary to maintain the safety and integrity of the App

5. Prohibited Conduct

When using Fanager, you agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to other users' accounts or our systems
• Interfere with or disrupt the App or its servers
• Reverse engineer, decompile, or disassemble any portion of the App
• Use automated scripts, bots, or scrapers to access the App
• Harass, bully, or intimidate other users
• Create leagues, teams, or content intended to deceive or mislead
• Circumvent or disable content moderation features
• Use the App to collect personal information about other users without their consent

6. Payments and Subscriptions

6.1 Purchases

Certain features of Fanager may require payment. All payments are processed by Stripe. By making a purchase, you agree to Stripe's terms of service and authorize the applicable charges.

6.2 Refunds

Refund eligibility is determined in accordance with the applicable app store's refund policies (Apple App Store). For questions about specific charges, contact us at support@kimusoft.io.

7. Intellectual Property

The App, including its design, features, code, graphics, and trademarks, is owned by Kimusoft LLC and protected by intellectual property laws. These Terms do not grant you any right to use Kimusoft's or Fanager's name, logo, or trademarks.

8. Account Deletion

You may delete your account at any time through the App's account settings. Upon deletion:

• Your account and personal data will be permanently removed
• Content you created (leagues, teams, matches, images) will be deleted or disassociated from your identity
• This action is irreversible and cannot be undone

We may also delete or suspend your account if you violate these Terms.

9. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or secure. We do not endorse or guarantee the accuracy of any User Content posted through the App.

Fanager is designed for recreational sports league management. We are not responsible for the organization, conduct, or outcome of any leagues, games, tournaments, or events managed through the App.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KIMUSOFT LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use or inability to use the App
• Any unauthorized access to or use of our servers and any personal information stored therein
• Any User Content posted through the App
• Any errors, bugs, or interruptions in the App

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY DOLLARS ($50), WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify and hold harmless Kimusoft LLC, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or in connection with your use of the App, your User Content, or your violation of these Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be resolved in the state or federal courts located in Florida.

13. Third-Party Services

The App integrates with third-party services including Google Sign-In, Apple Sign-In, Supabase, Firebase Cloud Messaging, Google Cloud Vision, and Stripe. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices or content of third-party services.

14. Changes to These Terms

We may revise these Terms at any time. We will notify you of material changes by posting updated Terms within the App and updating the "Last Updated" date. Your continued use of the App after revised Terms are posted constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the App.

15. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without cause and with or without notice. Upon termination, your right to use the App ceases immediately. Sections 4.1, 7, 9, 10, 11, and 12 shall survive termination.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Kimusoft LLC regarding your use of Fanager and supersede any prior agreements.
